1. Corporate Structure & Representation

Cognitive AI Agency is a registered sole proprietorship operating in accordance with the laws of the Republic of South Africa. All corporate contracts, recurring service tier subscriptions, and initial implementation setup fees are governed under this legal framework.

2. Artificial Intelligence Performance & Operational Liability

Cognitive AI Agency designs, configures, and maintains conversational AI modules, custom large language model (LLM) interfaces, and automated backend data pipelines based on proprietary data and parameters provided by the client.

  • Performance Limitations: While we implement industry-standard security guardrails, strict prompt engineering, and regular optimization protocols, artificial intelligence models are inherently subject to generative variance.

  • Liability Exclusion: Cognitive AI Agency holds no liability for instances of AI "hallucination" (the generation of factually incorrect or unverified data), data misinterpretation, or temporary operational disruptions caused by external third-party infrastructure providers (such as OpenAI, Anthropic, or Meta API frameworks). The client retains final accountability for monitoring, auditing, and managing their live customer-facing and internal AI interactions.

3. Protection of Personal Information Act (POPIA) Compliance

In strict compliance with the Protection of Personal Information Act (POPIA) of South Africa, Cognitive AI Agency acts as an operator handling data on behalf of our clients. We are fully committed to protecting all corporate knowledge bases, customer transcripts, and personal identifiers processed during system onboarding and automated execution. No proprietary business data or client information will be disclosed, repurposed, or compromised.
